If this translation and the Portuguese version differ, the Portuguese version prevails, except where the law of your country says otherwise.
1. About these terms
These terms apply to the Disco Draws app and to this website. The app is made for children, but the person who accepts these terms is the responsible grown-up (parent or legal guardian), by downloading or using the app. If you don't agree with them, don't use the app.
2. Who provides the app
Disco Draws is developed and provided by Daniel Chou, in Brazil ("we"). Contact: contato@discodraws.com.
3. Use with a grown-up nearby
The app is for children aged 3 and up, used under a grown-up's supervision. The grown-up sets the app up and decides about purchases, Ask Disco and usage statistics, which sit behind the grown-up check.
4. License
We grant you a personal, non-exclusive, non-transferable and revocable license to download and use the app on devices you own or control, for personal and family, non-commercial use. If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement also applies; if you downloaded it from Google Play, the Google Play Terms of Service also apply. We, not Apple or Google, are responsible for the app and its support.
5. No accounts: data stays on the device
The app has no sign-up or login. Profiles, progress and drawings stay on the device (and in its backup, if enabled). If the app is deleted without a backup, this data is lost and we cannot recover it.
6. Full Plan, free trial and packs
- Purchases are made and charged through the App Store or Google Play, on your store account, at the prices shown in the store before you confirm.
- The Full Plan is a monthly or yearly subscription. On your first subscription, the first 7 days are free. It renews automatically at the end of each period until cancelled: on the App Store, at least 24 hours before the end of the period, in Settings › your name › Subscriptions; on Google Play, in Google Play › Payments and subscriptions › Subscriptions. Cancelling stops renewal, and the plan stays on until the end of the period already paid.
- If the price changes, the store lets you know in advance, and you can cancel.
- The Full Plan covers every child on the device, on up to 3 devices with the same store account.
- The 50 Disco drawings a month start after the first charge (during the free trial, the 10 drawings to try apply) and don't carry over to the next month.
- Disco drawing packs (20 or 50) are one-time purchases, credited once to the device they were bought on, and they never expire.
- Refunds are decided and made by Apple or Google, under each store's rules.
- What the plan includes may change over time (for example, each month's special trail). If a change removes something important, we'll let you know in the app beforehand.
Nothing in these terms limits your consumer rights, including those under Brazil's Consumer Protection Code and the law of the country where you live.
7. Ask Disco (artificial intelligence)
- It is optional and works only after a grown-up turns it on. Requests go through filters, and Disco refuses topics unsuitable for children. Even so, a drawing made by artificial intelligence may differ from the request or have flaws. If a drawing seems inappropriate, let us know at contato@discodraws.com.
- Don't include full names, addresses, phone numbers or other personal data in requests. The app tries to refuse such requests.
- Drawings are for personal and family use: coloring, keeping and showing to the family.
- To prevent abuse, there are limits on requests per minute and per day.
8. What kids create
Drawings, paintings, photos and discs created in the app belong to whoever made them and stay on the device. We don't receive them (except the text of Ask Disco requests, as explained in the privacy policy). When sharing a drawing through the system share sheet, the grown-up decides who to share it with.
9. What is not allowed
- Copying, modifying, selling or redistributing the app or parts of it.
- Trying to obtain the app's source code, except where the law allows it.
- Getting around limits, purchases or protections (for example, changing the device identifier to get free drawings).
- Using the Disco Draws server in an automated or abusive way.
- Using the app for illegal purposes.
10. Intellectual property
The app, the disc drawings, the Disco mascot, the texts, sounds, voices and the Disco Draws brand belong to us or to those who licensed them to us. The Shantell Sans and Atkinson Hyperlegible fonts are used under the SIL Open Font License 1.1. Apple, iPhone, iPad, Apple Pencil and App Store are trademarks of Apple Inc.; Google Play and Android are trademarks of Google LLC.
11. Availability and changes
We work to keep the app running well, but it may have flaws, and features may change, be fixed or be discontinued. Ask Disco and purchases depend on the internet and on services from other companies (Cloudflare, OpenAI, Apple and Google), which may be unavailable at times.
12. Liability
In On paper mode, the phone is propped above the table: set the stand up carefully, with a grown-up, so the device doesn't fall. To the extent permitted by law, we are not liable for indirect damages or for the loss of data kept only on the device. Nothing in these terms excludes liability that the law does not allow to be excluded.
13. Privacy
What we do with data is in the privacy policy, which is part of these terms.
14. Changes to these terms
We may update these terms. The new version will be on this page, with its date. If a change is important, we'll let you know in the app or on the website before it takes effect.
15. Governing law
These terms are governed by the laws of Brazil. If you are a consumer, you may bring any claim in the courts where you live, and you keep the protections of your local consumer laws. First of all, talk to us: contato@discodraws.com.
